The Ministry of Finance confirmed KSeF invoicing errors can be fined up to 100% of VAT once penalties start on 1 January 2027, and rejected business calls to soften the regime further.
Why It Matters
Every VAT-registered company issuing e-invoices through KSeF is now on notice: from 1 January 2027 the tax office can fine you up to 100% of the VAT shown on a faulty invoice, or 18.7% of the gross amount when there is no VAT to charge. MF says the existing safeguards, reduced penalties for minor errors, force majeure waivers, and the offline24 fallback mode already answer entrepreneurs' concerns, so no further grace period is coming. The 2026 penalty-free window is the only time left to find and fix invoicing mistakes for free.
What To Do About It
Use the rest of 2026 to stress-test your KSeF invoicing flow: run a sample batch through the test environment, confirm your accounting software handles offline24 correctly, and have your bookkeeper log every rejected or corrected invoice now, since that log is your evidence if you ever need to argue a 2027 penalty down.
